Acceptance of Terms

By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Klix Soft PVT LTD.

Payment Processing

Payments are processed securely through our authorized payment partners:

• International Payments: Stripe

• Local Payments (Nepal): eSewa, Khalti

Billing Terms

• Subscription fees are billed in advance based on your selected plan

• All prices are displayed in applicable currency and include applicable taxes

• Payment is due immediately upon subscription activation or renewal

• Failed payments may result in service suspension until resolved

Refund Policy

Free Trial Periods:

• You may cancel during any free trial period without charge

• Cancellation must occur before the trial period expires to avoid billing

Subscription Refunds:

• Refunds are generally not provided for partial subscription periods

• Use aggregated, anonymized data for platform performance analytics, provided that user voice recordings and test responses are used solely for personalized recommendations and progress tracking, and are strictly excluded from training or improving core AI scoring models.

• Do not guarantee, replicate, or substitute official examination scoring or results (such as IELTS, PTE, OET, TOEFL, or Duolingo), and users shall not rely on platform assessments as official scores

• Are subject to technological limitations and ongoing improvements

• Should be used as practice tools, not definitive assessments

• May occasionally produce unexpected or inaccurate results

No Guarantee of Test Performance

Using our Services does not guarantee:

• Specific scores on official language proficiency examinations

• Improvement in English language proficiency

• Success in academic or professional endeavors

• Acceptance by educational institutions or employers

Continuous Improvement

We continuously work to improve our AI systems based on user feedback, technological advances, and educational best practices. System updates may affect scoring consistency over time.

• Ensure acceptance by educational institutions

• Meet your specific learning objectives

• Replicate official testing conditions exactly

Limitation of Liability

To the maximum extent permitted by law, Klix Soft PVT LTD shall not be liable for any reliance placed on platform results or content for official examinations, nor for:

• Any indirect, incidental, special, consequential, or punitive damages

• Loss of profits, revenue, data, or business opportunities

• Service interruptions or technical failures

• Actions or omissions of third-party service providers

• Any damages exceeding the amount paid by you for our Services in the 12 months preceding the claim

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.
